Terms of Service

Acceptance

These Terms of Service ("Terms") govern your use of Tagfire, a hosted analytics and tag-management application operated by Tagfire ("we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you are agreeing on behalf of a workspace, organisation, or employer, you confirm that you have the authority to bind that entity, and the words "you" and "your" in these Terms refer to that entity as well as to you personally.

Your account

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service. You are responsible for the activity that takes place under your account and for keeping your sign-in credentials confidential. If you suspect any unauthorised use of your account, notify us promptly at hello@tagfire.app and we will help you secure it.

Google data access

When you connect a Google account, you authorise Tagfire to access the GA4 properties and GTM containers you select, using the OAuth scopes that Google asks you to approve. You can revoke that authorisation at any time at Google account permissions. Tagfire's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy.

Acceptable use

You agree not to use the Service to access Google accounts or analytics properties that you are not authorised to access. You will not resell, sublicense, or white-label the Service without a separate written agreement with us. You will not reverse-engineer the Service or attempt to extract its source code, except where applicable law expressly permits it. You will not use the Service to send unsolicited messages, to infringe third-party rights, or to violate applicable law, and you will not probe, scan, or test the Service's security without our prior written permission.

Subscriptions and billing

Paid plans are sold and processed by Paddle, which acts as our merchant of record. Subscriptions are billed in advance on a recurring basis at the price, currency, and tax shown at checkout, and renew automatically until cancelled. You can cancel from your profile at any time, and your plan stays active through the end of the current billing period. All sales are final. We do not refund partial or unused portions of a billing period after cancellation, and renewal charges are non-refundable except in the limited situations described in our Refund Policy or where a refund is required by applicable consumer protection law.

Workspaces

A workspace owner is responsible for the conduct of the members they invite and for the data those members upload or connect on behalf of the workspace. The workspace owner can add or remove members at any time. If a workspace owner closes their account, the workspace and its content are subject to the retention rules in our Privacy Policy.

Intellectual property

The Service, including its software, design, content (other than your data), and trademarks, belongs to Tagfire and is protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. You keep ownership of any data you upload or connect, and you grant us a limited licence to host, process, and display that data solely so that we can provide the Service to you.

Public profile pages

If you create a public profile page at /u/your-username, the content you publish there is publicly accessible on the open web. Do not publish content that you do not have the right to share, that infringes a third party's rights, or that we would be required to remove under applicable law.

Disclaimers

The Service is provided on an "as is" and "as available" basis. Audit results, recommendations, and analyses are informational and are not a substitute for professional advice; we do not warrant that they are complete, error-free, or fit for any particular purpose. We are not affiliated with, endorsed by, or sponsored by Google.

Limitation of liability

To the maximum extent permitted by law, neither Tagfire nor anyone working with us will be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, even if we have been advised of the possibility of those damages. Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD 100.

Termination

You can close your account at any time from inside the Service or by emailing hello@tagfire.app. We may suspend or terminate your account if we reasonably believe you are in material breach of these Terms, or if your account poses a security or legal risk. On termination, your right to use the Service ends. Sections that by their nature should survive (in particular intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

Changes to these Terms

We may update these Terms from time to time. Where a change is material, we will give you reasonable notice by email or by an in-app notice before it takes effect. Your continued use of the Service after a change takes effect means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the federal or state courts located in Delaware, and you and we each submit to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you may have under the consumer protection laws of your country of residence.
